Terms of service.
These Terms of Service (the “Terms”) govern your access to and use of the JustineAI™ platform (the “Platform”) operated by Eve-Legal, LLC, a wholly-owned subsidiary of MindHYVE.ai, Inc. (“we,” “us,” “our,” the “Company”). By creating an account, accessing, or using the Platform, you agree to these Terms and the Privacy Notice, which is incorporated by reference.
If you do not agree to these Terms, do not access or use the Platform.
1. Acceptance
By creating an account or using the Platform, you represent that you are a licensed attorney in good standing with a US state bar, OR an authorized legal professional (paralegal, legal assistant, or law firm administrator) acting under attorney supervision, AND at least 18 years of age and legally capable of entering into binding contracts. The Platform is designed for US legal practice. Your use must comply with your state bar’s Rules of Professional Conduct.
2. Description of the service
JustineAI™ is an agentic legal operating system. The Platform provides AI-assisted case management, document generation, medical-record analysis, intake, demand-letter drafting, settlement-matrix modeling, and related capabilities for US litigation practices. The Personal Injury (PI) edition is currently in market. Additional editions — Workers’ Comp (WC), Medical Malpractice (MM), Mass Tort (MT), Insurance Bad Faith (IB), and Employment Class (EL) — are on the roadmap and not yet generally available.
Not legal advice. The Platform provides technology tools and AI-assisted features. It does not provide legal advice, legal representation, or a substitute for attorney professional judgment. All AI-generated content MUST be reviewed, edited, and approved by a licensed attorney of record before any external use.
3. Account registration and security
You agree to provide accurate, current, and complete registration information, to maintain the security of your credentials, and to be solely responsible for all activity occurring under your account. Sharing credentials, allowing unauthorized access, or circumventing security measures is prohibited.
4. Acceptable use
You may use the Platform only for lawful US legal practice purposes. You may not:
- Violate your state bar’s Rules of Professional Conduct.
- Breach attorney-client privilege or duties of confidentiality.
- Engage in the unauthorized practice of law.
- Submit fabricated, false, or misleading information to AI features.
- File AI-generated documents with courts without attorney review and approval.
- Reverse engineer, decompile, scrape, or otherwise interfere with the Platform.
5. Intellectual property
We own and retain all rights to the Platform, the JustineAI™ brand, the Eve-Legal™ F5/reasoner architecture, AI prompt libraries, system prompts, and the jurisdiction-specific reasoning content. You retain ownership of your case data, client information, uploaded documents, and work product. AI-generated content created in your tenant is your work product, subject to your attorney-client obligations.
6. Data and AI
Customer data is not used for training. Eve-Genesis (Law Edition) — the dataset that fine-tunes our domain reasoner — is 100% synthetic by construction. Your firm’s matter data is processed inside your tenant to deliver the service and is never used to train any model.
AI limitations. AI outputs may contain errors, omissions, or fabricated citations. You are responsible for verifying every legal citation, statute, and case reference before any external use, regardless of how confidently the AI presents them. AI does not substitute for attorney professional judgment.
7. Subscription and payment
The Platform is subscription-based. Plans are billed in advance on the agreed cadence. Subscriptions renew automatically unless canceled. Fee changes will be disclosed at least 30 days in advance. Subscription fees are non-refundable except where required by law or as expressly stated in a written agreement.
8. SMS communications
The Platform’s SMS functionality sends case-related communications via Azure Communication Services. SMS is opt-in only and not a condition of receiving legal services. Recipients may opt out at any time by replying STOP, UNSUBSCRIBE, CANCEL, QUIT, or END. Standard message and data rates from the recipient’s wireless carrier apply. Wireless carriers are not liable for delayed or undelivered messages.
9. Attorney-client privilege
Using the Platform does not create an attorney-client relationship between you (or your clients) and Eve-Legal, LLC, MindHYVE.ai, Inc., or any of their employees. We are a technology service provider, not a law firm. You are responsible for compliance with your jurisdiction’s rules on competence (Model Rule 1.1), confidentiality (1.6), candor toward the tribunal (3.3), and supervision of nonlawyer assistants (5.3) as applied to AI assistance.
10. Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE CASE OUTCOMES, SETTLEMENT VALUES, OR CASE SUCCESS RATES. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE. AI MAY PRODUCE INACCURATE OR FABRICATED CONTENT THAT MUST BE VERIFIED.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE FEES YOU PAID TO US FOR THE PLATFORM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY. WE ARE NOT LIABLE FOR LOST PROFITS, LOST DATA, REPUTATIONAL HARM, BAR DISCIPLINARY ACTIONS, COURT SANCTIONS, SETTLEMENT OR JUDGMENT AMOUNTS, OR INDIRECT OR CONSEQUENTIAL DAMAGES. YOU REMAIN SOLELY RESPONSIBLE FOR YOUR LEGAL WORK PRODUCT AND MUST MAINTAIN YOUR OWN PROFESSIONAL LIABILITY INSURANCE.
12. Termination
You may cancel your subscription at any time through account settings, effective at the end of the current billing period. We may suspend or terminate access for material breach of these Terms, non-payment, or legal or regulatory reasons. Upon termination, you have 30 days to export your data; thereafter we may delete it consistent with our Privacy Notice and applicable retention obligations.
13. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Before filing any formal proceeding, the parties agree to attempt informal resolution by written notice to legal@justineai.com for at least 60 days. Disputes not resolved informally will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Class action waiver: you waive the right to participate in any class action or class-wide arbitration. Claims must be filed within one (1) year of accrual.
14. Updates to these Terms
We may update these Terms from time to time. Material changes will be communicated via email or prominent notice at least 30 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance.
